WIDOWED PERSONS' RIGHTS IN KENYA 🇰🇪⚖️

Losing a spouse is painful enough. The law says you should NOT lose your dignity, property, or children too.

Here are your key legal rights protected by the Constitution of Kenya 2010:

1. PROPERTY & INHERITANCE RIGHTS

Protected by: Law of Succession Act Cap 160 + Constitution Art 40 + Matrimonial Property Act 2013

- Right to matrimonial home - You cannot be chased out. The home is protected whether in his/her name or jointly owned

- Right to inherit - If there’s NO will:

- Spouse gets 20% of the estate + life interest in the matrimonial home

- Children get 75%

- Parents/dependents get 5%

- Right to jointly owned property - Land, cars, business, bank accounts bought during marriage belong to BOTH. You get your 50% first, then share the rest

- Right NOT to be disinherited - Even with a will, courts can set it aside if it leaves spouse/children with nothing

2. PROTECTION FROM HARMFUL CULTURAL PRACTICES

Protected by: Constitution Art 44 + HIV Prevention & Control Act 2009

- NO forced widow cleansing

- NO forced wife/husband inheritance

- NO property grabbing by in-laws or relatives

- NO eviction* from matrimonial home

- NO shaving, seclusion, or rituals can be forced on you

These are illegal. You can report to police, chief, or FIDA.

3. CHILDREN & CUSTODY RIGHTS

Protected by: Children Act 2022 + Constitution Art 53

- Right to custody- Being widowed is NOT a reason to deny you custody. "Best interest of the child" comes first

- Right to child support- Children are entitled to maintenance from the estate

- Right to make decisions - School, health, religion for the children

4. ECONOMIC & SOCIAL RIGHTS

- Right to access bank accounts, NHIF, insurance, pension - After getting Letters of Administration from court

- Right to work and do business - No one can stop you

- Right to join chamas, get loans, own property in your own name

- Right to social protection - You can apply for government cash transfer programs for Orphans & Vulnerable Households through County Social Services

5.DIGNITY & EQUALITY RIGHTS

Protected by: Constitution Art 27 + Art 28

- Right to equal treatment- No discrimination because you are widowed

- Right to human dignity- No insults, stigma, "you are cursed" treatment

-Right to remarry - If and when YOU choose

2. Marriage Certificate - Proof of marriage

3. Title Deeds, Logbooks, Bank details

4. Letters of Administration- From High Court. This lets you legally access property
